Terms of Service

The short version: the website is free; the MCP tools need a Pro subscription that renews until you cancel; you own your data; we never promise results; and we only receive summaries and aggregates from your assistant.

1. Who we are and this agreement

These Terms of Service (the “Terms”) are an agreement between you and the company that operates Gamify It (“Gamify It”, “we”, “us”), a company based in Mexico. They cover the website at gamifyit.co and the Gamify It MCP service that you connect to AI assistants (together, the “Service”).

By creating an account, connecting the Service to an assistant or subscribing, you accept these Terms. If you use the Service for a company, you confirm you may bind it, and “you” means that company.

2. The Service

The website, including the Stage Map, the game, the case library, the playbooks and the calculators, is free and needs no account. The MCP service gives your AI assistant tools to diagnose your product’s growth stage, recommend and size experiments, read results and keep a history. Its tools require an account with an active subscription.

AI assistants such as Claude, Claude Code, Codex and ChatGPT are third-party products governed by their own terms. We are not affiliated with or endorsed by their makers. Your assistant, not Gamify It, reads your code, pages and data; we receive the summaries and aggregate numbers it sends.

We may improve, change or retire features. We will give notice before removing a core paid feature.

3. Your account

You sign in with a supported identity provider. Keep your account secure and tell us at jmdg@svenson.com.mx if you suspect unauthorized use. You must be old enough to form a binding contract where you live, and at least 18. The Service is for business and professional use.

4. Subscriptions, billing and taxes

Pro is priced per account and covers up to 3 products as fair use: $39 a month billed monthly, or $29 a month billed annually. Prices are in US dollars. Payments are processed by Stripe, and we never see or store your full card number.

Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time in your account; cancellation stops the next renewal and your plan stays active until the end of the period you paid for.

Sales tax, VAT or similar taxes may apply based on your location and are shown at checkout. If we change the price of your plan, we will tell you at least 30 days before the change applies to your next renewal.

The Expert Review add-on costs $1,500 per review and is billed when you order it. If a payment fails, we may pause paid features until it succeeds; your saved data is kept.

5. Cancellation and refunds

Refunds are described in our Refund Policy, which is part of these Terms.

6. Your content and data

You own what you send to and save in the Service, such as product descriptions, evidence summaries, aggregate metrics, Stage Cards and experiment records (“Your Content”). You give us a limited license to host, process and display Your Content only to provide, secure and support the Service for you.

The Service is designed to receive summaries and aggregates, not source code, raw event data or personal data about your own users. Don’t send that kind of data, and only share content you have the right to share. How we handle personal data is described in our Privacy Policy.

We do not use Your Content to train AI models. Any future feature that pools anonymized outcomes across customers will be opt-in.

7. Acceptable use

You agree not to:

  • use the Service in violation of law or the rights of others;
  • probe, scan or test the Service’s security, or bypass its access controls or usage limits;
  • copy, scrape or bulk-export the knowledge base, or use it to build a competing product;
  • resell, sublicense or share access to the Service outside your own team;
  • reverse engineer the Service, except where the law allows it despite this restriction;
  • send malware, or content that is unlawful, infringing or harmful.

8. Our content and intellectual property

The Service, the knowledge base, the software and our brand belong to us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use them while your account is in good standing.

The knowledge base paraphrases and cites published works, including books by Nir Eyal, Yu-kai Chou and Robert Cialdini. Those works belong to their authors and publishers; we are not affiliated with or endorsed by them. Other product names and trademarks belong to their owners and are used only to describe compatibility.

9. Recommendations are not guarantees

Gamify It gives evidence-graded recommendations and statistical readouts. We never promise a result, and past outcomes, including the cases on our website, do not predict yours. You decide what to build, test and ship, and you are responsible for how changes affect your product, your users and your compliance with the laws that apply to you. Nothing in the Service is legal, financial or medical advice.

10. Third-party services

The Service works alongside third-party services you choose, such as AI assistants, analytics tools, data connectors and payment providers. Their terms govern your use of them, and we are not responsible for them.

11. Disclaimers

Except as expressly stated in these Terms, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We do not warrant that the Service will be uninterrupted or error-free.

12. Limitation of liability

To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from these Terms or the Service.

Our total liability for any claim relating to the Service is limited to the amounts you paid us for the Service in the 12 months before the event giving rise to the claim. These limits do not apply where the law does not allow them.

13. Indemnity

If you use the Service for a business, you will defend and indemnify us against third-party claims arising from Your Content or your breach of these Terms, and we will give you prompt notice and reasonable cooperation.

14. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or end access if you materially breach these Terms, if required by law, or to protect the Service or other users; where reasonable, we will give notice first. After termination you can request an export of your saved data for 30 days, unless the law prevents it.

15. Governing law and disputes

These Terms are governed by the federal laws of the United Mexican States, and disputes will be resolved by the competent courts of Mexico City, unless the mandatory law of your country gives you, as a consumer, the right to bring claims elsewhere. Before filing a claim, please contact us so we can try to resolve it informally.

16. Changes to these Terms

We may update these Terms. For material changes, we will give at least 30 days’ notice by email or in the Service before they take effect. Continuing to use the Service after that means you accept the updated Terms.
